BOOKING CONDITIONS CONTRACT

1. General:

Great Trips Unlimited, Inc.acts only as a letting agent for the Property Owner or Cooperating Agency and is referred to in this agreement as the Agent. The contract is between the Owner and the customer who is referred to in this agreement as the Renter.  A booking made by telephone, fax or e-mail must be reconfirmed within three days by faxing, e-mailing or posting this signed Booking Conditions Form to Great Trips Unlimited, Inc., 3800 NE Sandy Blvd., Suite 212, Portland, Oregon 97232, fax  1-503-297-3508.  All reservations carry a 3-day option, but no booking shall be considered firm until the signed Booking Conditions Form has been received by Great Trips Unlimited, Inc. No booking shall be considered firm until the required deposit or full rental fee (depending upon the time period prior to the date of occupancy) has been received by the Agency by credit card payment, direct deposit into the Agent’s bank account or by check mailed to the Agent.

2. Internet Brochure Information:

The Agency takes care to insure the accuracy of the information provided. All information has been checked for accuracy and  it was accurate at the time it was published. The Renter must accept that minor differences may arise between photographs and/or verbal/written descriptions and the actual property. Occasionally, problems outside the Agency's or the Owners' control may arise which could mean that some facilities or services provided by the Owner become unavailable. If this occurs, the Agency will contact the Renter as soon as is reasonably practical to do so. Similarly, the Agency cannot accept responsibility for any changes or closures to local area amenities mentioned in the description or by staff members. It is the responsibility of the Renter to make specific requirements/needs known at the time of booking and to insure that the property selected fits his/her needs. Great Trips Unlimited reserves the right to make changes to particulars contained in its web site; the Renter will be advised of any major changes prior to booking.

3. Rental Tariffs

The Agency reserves the right to amend or change prices quoted due to error, omission, or price changes made by the Owner. Prices quoted by the Agent are believed to be accurate; however, the Agent will confirm the tariff with the Owner at the time of confirmation. The tariff shall be that which is confirmed by the Owner at the time of the availability confirmation.

4. Payment:

No legally binding obligation shall exist until the Agent has received a signed Booking Conditions Form and a deposit or full payment and has issued a written confirmation of its acceptance (a receipt) to the Renter. Once a booking is confirmed, the Renter is responsible for the total cost of the transaction as shown on the invoice. If a booking is made prior to two months of the rental date, the amount due is 50% of the rental price. The remaining 50% is due two months before the rental period. If your rental date is within eight weeks, full payment is required. The Agency will provide specific instructions to the Renter regarding this. If the balance of the cost is not received in accordance with the Booking Agreement, the booking will be canceled and the deposit forfeited.

5. Security Deposits

All Owners require a security deposit from Renters. Unless otherwise advised, it will be collected on arrival by the Owner or his/her representative. It is agreed by the Renter that this deposit shall be paid on arrival in US dollars cash. Some owners will accept a personal check while some ask the Agency to hold credit card details.  You will be advised regarding the specific deposit policies of the property you have selected.  Security deposits are refundable, less any damage or loss and less heating, electricity and telephone costs. The security deposit will be refunded at the time of departure or from ten to fourteen days after departure, depending upon the property. The Agency requires credit card information (specified below) in case the Renter neglects to bring the security deposit money or in case damages or losses exceed the security deposit required for that particular property. If it is necessary to charge your credit card, you will be notified prior to the charge transaction.

6. Cancellation by You:

To cancel your booking, notify the Agent immediately.  The Agent will try to re-let the property.  The Renter will remain liable for payment of the full amount of the rental. It is not always possible to re-let the property.

7. Refunds:

The Agent operates in accordance with each Owner’s refund policy.  The Agent is not responsible for or able to make alternate policies regarding the Owners’ refund policies.  Most owners will give a full or partial refund, but only only if the property is re-booked. All refunds, when allowed, may be subject to a substantial rebooking fee which will be taken from the amount of the refund before it is credited to the Renter. Agent labor charges, service charges, banking charges, accessory charges are not refunded under any circumstances.

8. Cancellation Insurance:

The Agency and Owners strongly recommend that Renters purchase Cancellation Insurance. Cancellation insurance is not included in the rental fee. The Agency will provide information cancellation insurance and this information is found on the Agent's web site.

9. Cancellations by the Owner:

The Agency accepts all bookings in good faith on behalf of the Owner. In the unlikely event that the Owner, for any reason, has to cancel the booking, the Agent will endeavor to offer you comparable accommodation. If the only alternative property is a higher price, the Agent reserves the right to charge the difference. If the Renter declines to accept the alternative accommodation, the Agent, on behalf of the Owner, will refund the full rental amount you have paid to us minus any fees charged by your financial institutions.

10. Alterations by the Renter:

Alterations of a confirmed booking can rarely be made; however, the Agent will change a date of renting a property if the Owner is willing and able to do so. Aamendments mayl be charged a re-booking fee.

11. Renter Obligations:

Under the terms of this agreement, the Renter agrees:To pay for all fuel, electricity, telephone and other extra charges, if applicable; To pay for any damage caused by Renter or Renter's guests' negligence, excluding reasonable wear and tear; To care for the property and leave it in a clean and tidy condition; To not allow the property to be occupied by more than the number of persons stated in the property description and the rental agreement; To cause no nuisance or annoyance; To allow the Owner and/or a representative reasonable access to the property. In an emergency, the Owner and/or representative may enter the property without notice; To present a Security Deposit to the Owner or representative on arriving at the property.

12. Party Booking

The Renter named on the agreement will be responsible for all members of the party and should insure that s/he is fully aware of these booking conditions. Lack of compliance dictate that the Owner or the Owner’s representative can refuse right of entry and, in this situation, no fees shall be refunded.

13. Renters with Special Needs

Great Trips Unlimited is dedicated to providing the highest quality accommodation to travelers with limitations of mobility, balance or vision. We seek out properties that accommodate travelers with mobility limitations. Every property we represent has an Accessibility Notice in its description. Unfortunately, many San Miguel buildings cannot be adapted for mobility limitations, because of their historical significance or building restraints or both.

14. Equipment and Other Services Charges:

Once payment has been made in full, fees for additional equipment and/or other services are not refundable.

15. Complaints:

The Agency believes that the quality of all of the properties we represent is considerably above average and that they represent good value. The Directors of the Agency have visited and inspected all properties unless you have been told otherwise. The descriptions reflect the quality of the properties. While every effort has been made to insure that descriptions of properties are accurate, neither these or any other representation or his/her representative in writing, by phone or in person while still in residence and shall be followed in writing to the Agent not later than seven days after termination of the rental. It is the Owner’s responsibility to resolve disputes regarding Renter complaints.

16. Provisional Reservations:

Provisional reservations can be accepted by telephone, but they must be confirmed within three working days by a deposit equal to 50% of the total rent or the entire cost of the rent if the date is 60 days prior to the holiday. Provisional reservations may be canceled after the three days have elapsed if the Agent does not receive the signed Booking Conditions Form and the appropriate payment. (Please refer to Item #3.)

17. Time of Letting:

The check in and check out times are specific to each property. The Renter shall be informed of these times. 

18. Limitation of Liability:

Great Trips Unlimited, Inc. is not responsible for any accident or injury to the Renter or guests, loss or damage to the property or to any Renter (including vehicles and contents). The Owner is not responsible for any injusry or accident to the Renter or guests, or loss or damage to the property or to any Renter, including vehicles and conten, except if this arises from proved negligence or default of Owners.

19. Contract:

This contract is made on the terms of these booking conditions. The contract will be governed by American courts. If any of the conditions is found to be invalid or unenforceable, the remainder will not be affected.

20. Previous Descriptions or Verbal or Written Statements:

The current web site and booking conditions supersede and cancel all previous written and verbal statements.
